Prayagraj: In a special sitting, the Allahabad High Court on Sunday dismissed a petition filed by Vijay Mishra, an advocate of Atiq Ahmad and an accused in Umesh Pal murder case, seeking parole (short term bail) to perform last rites of his mother.
The court dismissed the petition for parole after the state counsels brought to the notice of the court that the funeral of Vijay Mishra's mother was performed on May 11 and his brothers were present there. Therefore, there is no need for granting parole.
Taking note of the submissions of the state, Justice Sanjay Kumar Singh observed, "Much emphasis has been given by contending that as per customs, the person, who performs cremation/funeral ceremony also performs other rituals. Lastly it is submitted that the present case relates to Umesh Pal's cold blooded, broad daylight murder case, which took place in the heart of the city and in case, the applicant is released on short term bail, there is every possibility of his absconding and involving in criminal conspiracy, as co-accused Shaista Parveen, wife of late Atiq Ahmad and Guddu Muslim are still absconding."
"The counsel for the applicant does not dispute the aforesaid submissions placed on behalf of the state with regard to cremation/funeral of applicant's mother on Sunday at 01.30 pm as well as criminal history of the applicant," the court added.
"In view of the above, as of now, it is not in dispute that the cause of this short term bail application for performing cremation of applicant's mother has lost its efficacy, therefore, the aforesaid prayer has rendered infructuous," the court said.
